Terms and Conditions

1. Definition of “Membership”

Membership within the American Transcription Association (ATA) is divided into the following categories:

  • Transcriptionist (U.S.-Based Transcriptionist)
  • Transcription Company  (U.S.-Based Transcription Company)
  • Allied Member (from related fields e.g. VAs, etc.)
  • Vendor Member
  • Associate Member (from an unrelated field)

***PLEASE NOTE***

If you are an individual or freelance transcriptionist or a transcriptionist who works as an employee or subcontractor of a service, company, hospital, etc., you would register as a Transcriptionist.

If you own a transcription company you would register as a Transcription Company.

If you are in a related field such as a Transcription Supervisor, Quality Assurance, VA, Court Reporter, etc. you would register as an Allied Member.

If you are a vendor interested in supporting our industry you would register as a Vendor Member.

Anyone else interested in supporting our industry from an unrelated field, you would register as an Associate Member.

All members must comply with these General Terms and Conditions. Transcriptionists and Transcription Companies have additional Rights and Obligations, as described below.

Any individual or entity that falls into one of the above categories may apply for membership to the ATA. However, the ATA reserves the right to deny membership for any reason. Further, Transcriptionists and Transcription Companies must fulfill certain criteria to be considered for inclusion.

Should the ATA deny membership, a full refund of all dues paid will be provided after notification has been made to the applicant.

Once accepted, all members will be able to take full advantage of Member Benefits including vendor discounts and other offers as they become available to the ATA.

The ATA reserves the right to revoke membership should a member be found to be in violation of these terms and conditions, or for any other reason deemed to be good cause by ATA.

Members may also terminate their membership status by notifying the ATA in writing (full contact information is provided at the end of this document.) However, once an application for membership has been accepted, there will be no refunds of membership fees.

Members must be in good standing (i.e., be up to date with their fees and not in violation of any Rule or Regulation of ATA published from time to time) in order to maintain their membership status. A grace period of 30 days will be allowed to bring dues current or remedy any violation of ATA’s Rules and Regulations. However if dues are still outstanding after 30 days or if a violation is not remedied in that time, the ATA reserves the right to revoke membership.

2. Additional Rights and Obligations of Transcriptionists and Transcription Companies

In addition to the benefits outlined above, Transcriptionists and Transcription Companies have the following rights:

  • The right to vote on any motion(s) set forth by the ATA

Other rights may be included in this document at a later date.

Transcriptionists and Transcription Companies also have the following obligations:

  • Must be a 100% U.S. company or individual
  • Must perform all transcription work in-house OR subcontract only to U.S. employees/individuals legally working within the U.S.
  • Must not subcontract any transcription work overseas
  • Must not subcontract any transcription work to companies that subcontract transcription work overseas

The ATA believes that in order to build a strong and vibrant domestic transcription industry, we ourselves must uphold these standards.

Other obligations may be included in this document at a later date.

3. Dues

Membership dues will be payable annually, on the anniversary date of application*. Members/applicants acknowledge that PayPal will be the transaction provider for dues, payable either through the member’s PayPal account or by credit card.

Dues are as follows:

  • $99 Transcriptionists and Allied Members
  • $149 Transcription Companies and Associate Members
  • $249 Vendor Members

4. Access to the Members Center

1. You must have a username and password to access the Members Center of the ATA website. You shall keep your username and password secure and confidential and use it only for your own authorized access, or for that of employees within your company. You are solely responsible for all activities that occur with your password. You shall notify ATA immediately of any actual or suspected unauthorized use of your password. ATA is not responsible for any consequences that result from any unauthorized use of your password.

2. All Members who participate in the ATA Forum will be held to the Posting Policy, as outlined within the Forum. Members who do not conform to the Posting Policy may have their memberships revoked.

5. No Agency

No agency, partnership, joint venture, franchise, or employment relationship is created between the American Transcription Association and You or Your Company as a result of these Terms and Conditions or Your Company’s participation in the ATA. Further, neither party is authorized to create any obligation, express or implied, on behalf of the other.

6. Assignment

Membership is not transferable or assignable. The ATA may assign or delegate its rights and/or obligations, in part or in whole, under this agreement to any of its subsidiaries that are wholly owned directly or indirectly by the ATA.

7. Order of Priority

The English language version of these Terms and Conditions shall prevail over any translations of them. The terms of any trademark license agreement(s) shall prevail over these Terms and Conditions with respect to the subject matter of the trademark license agreement.

8. Waiver

Failure to enforce any of these Terms and Conditions shall not constitute a waiver of such terms, nor affect their enforceability.

9. Governing Law and Forum

Any claim arising under or relating to the ATA, the materials, or the websites shall be adjudicated in the Court of Common Pleas of Bucks County, PA and the applicable law shall be that of the State of Pennsylvania, without reference to its conflict of law principles.

10. Limitation of Liability

NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The ATA shall not be liable to any Member if an ATA employee or any other party acting on behalf of the ATA accesses or updates the personal and/or business profile information.

11. Variation of Terms & Conditions of Membership

The ATA may from time to time alter, amend, modify, add to, vary or replace any of the provisions of these Terms and Conditions of Membership at any time and without further notification. Every such amendment, modification, addition, variation or replacement shall take effect on such date as the ATA may prescribe and shall be binding on all Members.
